Terms and Conditions

    The online payment terms and conditions (“Terms”) apply to the use of the online payment transaction service (the “Service”) made available by the Judiciary of Mauritius. These Terms constitute a contract between you and The Judiciary. Please read them carefully. These Terms may be altered or added to by Us at any time, with or without notice. By using the services, you agree to be bound by the provisions of these Terms.
  • 1.
    Terms
    • 1.1.
      These Terms form part of the online payment terms and conditions which govern your access to and usage of the E-Payment facility. By agreeing to comply with the Terms you also agree to comply with the terms and conditions of use. If there is a conflict between The Judiciary website terms and conditions of use and these Terms, these Terms shall prevail.
  • 2.
    Grant of Rights
    • 2.1.
      You may use the E Payment facility for the purpose of making payments to The Judiciary via online credit/debit card transaction, MauCas QR Code and Internet banking, provided that you do not:
      • 2.1.1.
        In any way damage or disrupt the Service and/or the operation of the Service;
      • 2.1.2.
        Use the Service for any unauthorised or unlawful purpose.
    • 2.2.
      Payments may be made using the Service for Fixed Penalty Notice (FPN) issued by Mauritius Police Force, Court Fines and Fees from the Judiciary
    • 2.3.
      There is no merchant service fee (Commission) applicable to the online payment made by the user.
    • 2.4.
      The Judiciary reserve the right to suspend, amend or cancel the Service at any time either temporarily or permanently.
  • 3.
    Payment
    • 3.1.
      Payments using the Service may be made using Visa MasterCard, Payment Apps compatible with MauCas QR Code and Maucas Account Transfer/Internet banking.
    • 3.2.
      The Judiciary is not directly involved in the online payment but through a third party service provider.
    • 3.3.
      All payments are to be made to the Judiciary in approved currency; – Mauritian Rupees (Rs)
    • 3.4.
      Payment classifications
      • (a)
        Fixed Penalty Notice (FPN) issued by Mauritius Police Force – Payment must be made in Full no later than the final date for payment set out in the FPN Form or SMS notification.
        • (i)
          Road Traffic offence
          • a.
            Users can search the outstanding payment by providing the EpNo or FPN No and Registration Mark of Vehicle Or FPN Noa and National Identity Card No/Passport No as stipulated in the FPN form/SMS Notification.
          • b.
            Users will not be allowed to pay a FPN with an occurrence code (CRTO). A message will be displayed on the website
        • (ii)
          Other Fixed Penalty offence
          • Users can search the outstanding payment by providing the FPN No and National Identity Card Number/Passport No as stipulated in the FPN form.
    • 3.5.
      Upon completing a transaction using the Service, you will be presented with a confirmation screen verifying the transaction details you wish to process. It is your responsibility to verify that all transaction information and other details are correct.
    • 3.6.
      We have no liability for transactions which are incorrect as a result of inaccurate data entry in the course of the use of the Service or for loss of data or information caused by factors beyond Our control.
    • 3.7.
      You will be notifed once the payment has been processed successfully. A receipt can be downloaded after successful payment
    • 3.8.
      Once a payment has been made it cannot be cancelled. Refund is not applicable.

    Privacy and Use of Information
    • 4.1.
      The Judiciary will comply with the Data Protection Act in relation to any applicable information you supply to Us.
    • 4.2.
      Any personal information supplied by You may be retained by the Judiciary until such time as you request that the information to be removed.
    • 4.3.
      We will use any information you give to Us and which identifies you only for the purpose for which it is supplied to Us, including contacting you to verify your credit card information, and will not use it for any other purpose or supply it to any third party except as required by law, authorised by You or set out in these Terms.
    • 4.4.
      Payments using the Service are made through a secure third party website. We will use all reasonable endeavours to prevent unauthorised access to your Personal Information. However, We will not be liable for any direct or indirect damage or loss whatsoever for any interception and/or ‘hacking’ of any data or other unauthorised access to information provided by you for the purposes of using the Service.
  • GOVERNING LAW
    • (1)
      This Agreement shall be governed by and construed in accordance with the laws of Mauritius. The parties agree to submit to the exclusive jurisdiction of the courts of Mauritius.
    • (2)
      Recognising the global nature of the Internet, the User agrees to comply with all local rules regarding online conduct, acceptable content and use of the Websites and the Services.
  • 5.
    GENERAL
    • (1)
      The Registered User shall not, in any litigation proceeding, challenge the admissibility as evidence or the accuracy of a data log or electronic record provided by The Judiciary in whatever form it may be presented.
    • (2)
      Nothing in this Agreement shall constitute or be deemed to constitute a partnership between The Judiciary and any User, nor constitute the appointment of third parties as agent of any User or The Judiciary.
    • (3)
      If any terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will nevertheless continue in full force.
    • (4)
      The User shall be deemed to have read this Agreement and shall agree to be bound by the terms hereof. This Agreement shall supercede all proposals, prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this Agreement software.
    • (5)
      BY SUBMITTING A PAYMENT THROUGH THE ONLINE-PAYMENTS SITE YOU ARE AGREEING TO THESE TERMS AND CONDITIONS INCLUDING ANY UPDATED CHANGES IN TERMS AND CONDITIONS FROM TIME TO TIME THROUGH OUR WEBSITE.-
